On January 21, 2010, Ms. Katie Tagle petitioned Judge Robert Lemkau to modify a custody order to prevent her 9-month old son’s father, Steve Garcia, from having unsupervised visitation with the infant. Judge Lemkau not only ignored the fact that Mr. Garcia had made death threats against Ms. Tagle and her son by phone, e-mail, texts, suicide letters and even short novel, but he also told Ms. Tagle that she was lying!
Judge Lemkau ordered Ms. Tagle to turn her baby, Wyatt, over to Garcia and, within 10 days, Garcia had shot Wyatt and himself to death.
This is not the first of Judge Lemkau’s errors in judgment, but the consequences were catastrophic. Fortunately, Judge Lemkau’s term is up and he must run for re-election. Unfortunately, notwithstanding the disastrous results of his actions, he has filed his papers to run!
If no one runs against Judge Lemkau, he will have another 6 years on the Bench. The People of San Bernardino County deserve a legal system which reviews all the evidence available and protects its citizens.
I need your help to get the word out to all the people in San Bernardino County that they MUST vote to remove Judge Lemkau and Elect James Hosking for Superior Court Judge on June 8, 2010!

In an interview given to the SBCBA Bulletin in 2007, Lemkau claimed to the San Bernardino County Bar Journal that he was motivated by "the opportunity to make a positive impact on people that would appear before me." - San Bernardino County Bar Journal
James Hosking believes that Judge Lemkau's actions prove how false this claim was.
Moore quoted Rick Tagle, Katie's ex-husband and father of her son Dakota, as telling her, "The (Victorville) judge had not read the exhibits. Just from the very beginning, he didn't want to listen. He started out by saying, 'one of you is lying. I think it's you,' and pointed to Katie."

The judge turned down Tagle’s petition for an ex parte restraining order — a kind of emergency order made without a full hearing.

Days before his death, Garcia posted desperate messages to his ex-girlfriend, Katie Tagle, along with pictures of himself and his son Wyatt and video clips of the baby at a younger age.
